Such as the case from TRG. Don't go into legalities with me because you'll only lose, keep in mind you dont know what I do for a living. My point was, the guy is a beginner, seems to have credited pretty much everyone to this point and was probably looking for CONSTRUCTIVE criticism, not bashing for ripping when the poor guy probably didn't know what that even was. The point is, everyone needs to ligthen up on this site, i see so much negativity, this is a game, it's suppose to be fun, running someone down will only discourage them from painting and i personally enjoy as many painters as possible to keep originallity around and new, creative ideas. This guy could turn out to be the next masgrafx, so instead, think of a different way of approaching him about it, maybe send him a message, politely telling him what he did wrong, and not being negative in a comment under his release (rsj). If we run off all our painters, our future of this game, that already swings in the grasps of death, will be gone. That is all. |

Many of these logos are released, free to use as long as you don't make a profit from it. Our copyright at TRG say that the car files used are ours, and that you shouldn't be taking it and stealing the images of the logos/numbers. The moral details are more important than the laws here. Taking the numbers off of the car is stealing, no matter how you look at it. Even if someone stole a bag of M&M's and admitted that he stole it, he would still be accused of stealing. Sad really when he could get that same bad of M&M's for a dollar he had in his wallet. Same goes here, as there are at least two 84 numbers that he could have downloaded. Plus you'd have to think about how long the painter spent on the cars, possibly making everything from scratch. |

What is copyrighted is the name, "The Racing Groove". To say no files shall be used without permission is simply a hollow threat. First, painted cars cannot be copyrighted, well they can, but no one ever would. You cant copyright something thats already copyrighted. I cant paint a picture of a cartoon character say, and copyright it just because I painted it. The names and images of car makes, sponsors(including all contigs), Im sure paint schemes and numbers are owned by the teams and/or designer. You could get permission to reproduce, in which the wording would be "copyright reprinted, reproduced, retransmitted, etc. with permission". Secondly, after all that, one would need a copyright lawyer to make sure all is legit, which in a best case scenario would be into the thousands of dollars per car, giving the number of variables involved. Thirdly, one could not have a succesful lawsuit over something like this because, a)its not your copyright to sue over, and b)no financial or intellectual gain has been made by the perpetrator, nor suffered by the plantiff. Wrap your heads around that. |

On two different places on the main page at TRG it says "Copyright © 2008 All Rights Reserved All downloads owned by The Racing Groove." That also means parts of the files, and since the number was part of the file, it's in breach of copyright laws. Since the file is copyrighted, we could just as well take him to court, but we won't because it isn't worth it. Just take the car down to avoid further trouble. |
